You are here: Confidentiality Clause Drinks Media Wire

First edition: April 2005

Introduction

Drinks Media Wire is designed for net users throughout the world (companies, organizations, media, journalists, agencies, professionals and private individuals) involved in the drinks and gastronomy sectors. With this aim, and acting as the first press relations site on the Web specialised in this field, DMW lists thousands of people and updated documents.
DMW thus undertakes to provide information and services of optimal quality for its users. Moreover, in addition to the proposed efficiency, DMW pointedly respects the rights and privacy of all and safeguards the confidential aspect and security of personal information.

Definitions

DMW is available for three categories of Internet users according to how they use the site:

  • The user has free and anonymous access to DMW in order to obtain information which may be of temporary or secondary interest: this group principally comprises people (students, oenologists, cellarmen, chefs, tasters, checkers, editors, the inquisitive) whose involvement is undetermined. In principle, the user is an occasional receiver, and is unlisted on the site, but each sender or receiver is defined as a DMW user.
  • The sender (> PRO Access & COM Access) has contractual and therefore registered access to DMW in order to promote information concerning his activity. This group principally comprises companies (producers, traders, PR agencies, etc.), private parties (chefs, oenologists, cellarmen, sommeliers, communication consultants, etc.) and organizations (interprofessional committees and unions, event organizers, societies, etc.) for whom communication is an essential form of market exposure. The sender can, at the same time, be a receiver (competitive scanning, etc.); his profile is listed on the site in order to target his releases.
  • The receiver (>MEDIA Access) has free and registered access to DMW in order to regularly obtain information which he is subsequently liable to diffuse. This group principally comprises professionals in the information sector (journalists, checkers, media, press agencies, etc.) for whom information processing is the predominant part of their work. The receiver can, at the same time, be a sender (publication of a written work); his profile is listed on the site in order to improve the congruence of the releases he is to receive.

Forms

Senders and receivers register with DMW by means of a form which they fill in and in which they specify their surname, first name, profession, work station, address, telephone and fax numbers, e-mail address, sector of activity, languages spoken, centres of interest, published works (journalists), etc.
Whichever category you belong to, this information is necessary to assist DMW in providing the best possible service. It is uniquely for internal use and can never be exploited in other ways other than those defined by Drinks Media Wire, and in particular can never be transferred or leased out either for valuable consideration or free of charge, or be disclosed to a third party, excepting in the following cases:

  • If DMW esteems it necessary to disclose this information in accordance with the law and according to the degree of infringement of legal proceedings concerning DMW's conditions of use (>cf. Conditions of use);
  • In the case of legal action being taken against a natural person or legal entity which could impair the rights and security of people or property of a third party, whether the latter is a DMW user or not;
  • In the case of an express claim by court order, provided that no legal appeal can be made against the claim in question.
